Terms of Service

Ineedthat | www.ineedthatdesigns.com

Last updated: 26 October 2026

These Terms of Service (“Terms”) govern use of www.ineedthatdesigns.com and purchases from Ineedthat, operated by Simon Mischa van der Schaar in Western Australia. Please read these Terms together with our Privacy Policy, Returns & Refunds Policy and Intellectual Property & Infringement Policy. Mandatory consumer rights always prevail over an inconsistent term.

1. Business Identity and Contact

Trading name: Ineedthat. Operator: Simon Mischa van der Schaar. Website: www.ineedthatdesigns.com. Customer service and legal enquiries: helpingyou@ineedthatdesigns.com.

References to “we”, “us” and “our” mean the operator of Ineedthat. The terms “Ineedthat” and “I NEED THAT” refer to our trading name and do not, by themselves, assert that a company or registered trade mark exists.

2. Eligibility and Use of the Website

You must be able to enter a lawful purchase agreement or have appropriate parental or guardian permission. You agree to give accurate, up-to-date order details and to use the website without interfering with its security, integrity or other customers.

• Do not attempt unauthorised access, payment fraud, malicious interference, impersonation or use of stolen account or payment details.

• Do not use bots to disrupt the site, harvest personal data, bypass security restrictions or commercially extract product images, videos, descriptions or design files in violation of these Terms or applicable law.

Ordinary browsing, accessibility tools, personal record keeping and lawful uses protected by statute are not prohibited by these Terms.

3. Products and Product Descriptions

We offer wall art (including posters, canvas and framed or metal prints), clothing, phone cases, jigsaw puzzles and other designs or physical merchandise as displayed on our site. Many items are manufactured or printed after purchase by third-party fulfilment partners.

We aim to present images, colours, product details and sizing accurately. Screen differences and reasonable manufacturing tolerances may cause minor variation. Any material variation, inaccurate description or defective item is handled under our Returns & Refunds Policy and applicable consumer guarantees.

4. Orders, Pricing and Payment

A product listing is an invitation to place an order. Your order is subject to acceptance and availability. The price, currency, delivery charges and applicable taxes shown at checkout form the basis of the purchase. We may correct obvious listing mistakes before accepting an order and will notify you if a material correction affects your proposed purchase.

We may decline an order for a legitimate reason, such as unavailable stock, unsupported delivery regions, suspected fraud or an obvious price error. If an accepted order must be cancelled by us, we will refund amounts paid for the cancelled goods and applicable associated delivery charges.

Payments are processed through the providers presented at checkout. We do not require you to send full payment card details by ordinary email.

5. Production, Shipping and International Orders

Orders may be produced by third-party print-on-demand facilities and shipped from different countries depending on the product and delivery destination. Delivery estimates are estimates, not guaranteed deadlines unless expressly stated. We remain responsible for our obligations as the seller even when an external partner manufactures or dispatches the goods.

You must provide a deliverable shipping address. Import taxes, duties and customs procedures may apply outside the relevant dispatch country; any charges for which the customer is responsible should be communicated before checkout where required by law.

If goods are delayed, lost, damaged or incorrectly delivered, contact us. Statutory delivery and consumer rights are not limited by a carrier’s or fulfilment partner’s own terms.

6. Returns, Refunds and Cancellations

Our Returns & Refunds Policy explains how to report a problem, request a remedy and contact us before returning an item. Because many products are made to order, we generally do not offer voluntary returns for change of mind or customer selection errors where law permits.

Nothing in these Terms or the Returns & Refunds Policy limits rights under the Australian Consumer Law or mandatory overseas consumer protection rules, including any applicable UK or EU online-purchase cancellation rights. Goods made after an order is placed are not automatically exempt from those rights merely because they are produced on demand.

7. Ownership of Website Content and Designs

Original artwork, artwork arrangements, text, photographs, product mock-ups, website elements, promotional graphics, animation, video and sound elements may be protected by copyright and other rights, to the extent the law recognises those rights. Rights in qualifying original material belong to Simon Mischa van der Schaar or other identified owners/licensors, as applicable.

Ineedthat may use human-created, AI-assisted and licensed material. AI assistance does not automatically establish copyright, ownership or exclusivity in every output. Trade marks and registered designs have separate legal requirements, and third-party rights are respected.

Buying a physical item gives you ownership of that physical item subject to ordinary law. It does not transfer the right to reproduce artwork or manufacture additional products featuring it. Lawful resale or gift of the physical item is not prohibited simply because it carries our artwork.

8. Permissions and Restrictions on Content Reuse

We permit ordinary personal viewing of publicly displayed product images and site content. Without written permission, you must not, except where law permits:

• Reproduce, sell, publish or distribute protected artwork or production files as standalone images or as prints, clothing, cases, puzzles, templates, advertising material or other merchandise.

• Upload protected artwork to another print-on-demand service, stock-image marketplace, NFT service or commercial catalogue.

• Copy or extract a substantial part of protected creative content through unauthorised scraping, image harvesting, automated extraction or bypassing technical restrictions.

• Use protected site content as a training dataset or input for commercial generative-model training, fine-tuning or competing reproduction where our permission is required and no legal exception applies.

• Remove copyright notices, attribution or rights-management information in circumstances prohibited by applicable law.

• Misrepresent Ineedthat as affiliated with, endorsing, or authorising a competing seller.

Alteration, tracing, use of screenshots, “inspiration” or use of an AI tool does not necessarily make an otherwise infringing copy lawful. Equally, these Terms do not override lawful quotation, fair dealing, fair use, personal copying, accessibility rights or other exceptions that apply under relevant law.

9. AI-Assisted Designs, Advertising and Promotional Videos

Artwork and advertising on the site may contain AI-assisted visual elements, fictional characters, voiceovers, animation, video frames or other creative material. We claim rights only in material or components we own or validly license, to the extent protected by law.

You may not commercially re-use protected frames, sound, artwork or animations without permission where such use would infringe a relevant right or breach an enforceable contractual obligation. No affiliation with third-party brands, platforms or people is intended unless expressly identified.

10. Customer Reviews and Submissions

If we enable ratings, photographs, reviews or other customer submissions, you remain responsible for having the necessary rights to share them and for avoiding unlawful, misleading or abusive material. You grant us a non-exclusive permission to display and moderate content you submit through the website as needed to operate those features. Separate permission will be sought where required for unrelated advertising use of personal images or content.

We may remove material that violates the law, infringes rights or breaches reasonable website rules. We will handle personal information in submissions consistently with our Privacy Policy.

11. Third-Party Services and External Links

Our website may connect to external payment processors, delivery services, fulfilment partners and other third-party websites. Their separate terms may apply to services they provide directly. This does not reduce our responsibilities as the retailer for goods we sell.

12. Responsibility, Liability and Indemnity

Nothing in these Terms excludes, restricts or modifies guarantees, remedies, liabilities or other rights that cannot lawfully be excluded, including under the Australian Consumer Law.

Subject to those rights, we are not responsible for losses that do not arise from a breach of our legal duties or that the law does not make us liable for. Any permitted limitation is to be interpreted no more broadly than applicable law allows.

You agree to compensate us for direct, reasonable losses caused by your unlawful or deliberately wrongful use of the website or infringement of our rights, to the extent the law permits. This clause does not require you to indemnify us for our own negligence, fault, breach or statutory obligations.

13. Intellectual Property Enforcement

We may send legitimate cease-and-desist letters, make platform reports or pursue available remedies for established or reasonably suspected infringement. We will assess ownership, relevant exceptions and available evidence before issuing formal allegations. See our Intellectual Property & Infringement Policy for reporting and takedown procedures.

14. Privacy and Customer Communications

Our Privacy Policy explains how we collect and use information. Order messages may be necessary to fulfil a contract; promotional messages are subject to the consent and unsubscribe rules that apply.

15. Changes to Terms

We may update these Terms for future visits or purchases by publishing an updated version with an effective date. Changes will not retrospectively remove rights under orders already accepted or statutory protections. Where required, we will notify customers of material changes.

16. Governing Law and Disputes

To the extent legally permitted, these Terms are governed by the laws of Western Australia, Australia, and its courts have non-exclusive jurisdiction. Mandatory consumer or privacy laws of another country may still apply, and rights in intellectual property outside Australia are determined under the relevant jurisdiction’s law.

If you have a concern, please contact helpingyou@ineedthatdesigns.com first so we can try to resolve it fairly. This does not prevent you from contacting consumer authorities, seeking legal advice or exercising legal rights.

17. Business Ownership and Succession

The operator’s intellectual property and other business assets are dealt with according to their legal ownership, contracts, applicable succession law and any valid will or estate-planning instruments. These website Terms do not transfer assets upon death or incapacity or determine beneficiaries. Authorised representatives may manage rights where legally appointed.

18. Severability and No Waiver

If any term is found invalid or unenforceable, the remaining terms will continue to apply so far as legally possible. Not immediately enforcing a right does not necessarily waive it.
