Intellectual Property & Infringement Policy
Ineedthat | www.ineedthatdesigns.com
Last updated: 26 October 2026
This policy explains how Ineedthat protects its original and properly licensed creative work, reports suspected infringements on other services and receives copyright or intellectual property complaints about content appearing on our own website. It supplements our Terms of Service and is not a substitute for legislation or a platform’s formal legal process.
1. Rights Holder and Contact Details
Trading name: Ineedthat. Website: www.ineedthatdesigns.com. Operator and creator of qualifying original material: Simon Mischa van der Schaar. IP contact: helpingyou@ineedthatdesigns.com. Based in Western Australia, Australia.
Rights are asserted only to the extent the operator owns them or is authorised to act for the relevant rights holder. Some artwork, software, fonts, music or other elements may be supplied under licences or subject to third-party rights.
2. Material We Seek to Protect
• Original visual artwork and distinctive design compositions used for wall art, apparel, phone cases, jigsaw puzzles and other merchandise.
• Qualifying original text, photographs, creative video sequences, animation, music, editing and graphic elements in website pages and advertising.
• Product photography, original mock-ups, artwork files, descriptions, branding elements and original website content.
• Confidential creative materials, production assets and non-public workflows where legally protected or subject to enforceable contractual restrictions.
An item may remain protected after resizing, cropping, recolouring or format conversion, if a substantial part of protected expression is unlawfully copied. However, mere similarity, a shared concept, a standard hardware shape or AI generation alone does not necessarily establish infringement.
3. Legal Rights and Their Limits
Australian copyright may arise automatically in qualifying original human-authored artistic, literary and audiovisual works. It does not protect an idea, style or concept on its own. Separate requirements may apply to trade marks, registered designs, confidential information and third-party licences.
We respect applicable legal exceptions and defences, including fair dealing, fair use, criticism, review, reporting and other permitted activity as they apply in the relevant jurisdiction. A lack of written permission is not, by itself, proof of infringement in every situation.
4. Examples of Potential Unauthorised Commercial Use
• Reproducing protected designs onto competing wall art, clothing, phone cases, puzzles or other goods without permission.
• Uploading substantial protected artwork to third-party print-on-demand platforms, marketplaces or image libraries.
• Using protected video frames, animations or illustrations to promote competing products without appropriate rights.
• Removing attribution or rights information in circumstances prohibited by law.
• Copying substantial protected content via automated extraction, including for unlicensed model training, where protected rights or enforceable conditions apply.
Actions may also breach our Terms of Service, but contract restrictions and copyright infringement are distinct legal questions. We will not automatically describe every breach of our preferences as a criminal offence or wilful infringement.
5. Reporting Suspected Theft of Ineedthat Content
If you discover a listing, social media post or website apparently copying our creative work, email helpingyou@ineedthatdesigns.com. Where possible, include:
• The original Ineedthat product or webpage link and the allegedly infringing link.
• Screenshots, dates, product titles, seller or account names and platform details.
• A brief description of the apparent reproduction and, if known, evidence of when our original material was created or published.
We may preserve dated originals, source and working files, production records, archived listings, licences and correspondence to assess ownership and evidentiary issues. We do not guarantee continuous monitoring or that any particular detection technology is used.
6. Our Approach to Takedown Requests
Where there is a reasonable basis, we may contact a seller, marketplace, host, social media service or their nominated rights-complaint channel; request removal or clarification; seek a negotiated resolution; or obtain legal advice about formal enforcement.
For content hosted in the United States, a qualifying copyright owner or authorised agent may use the Digital Millennium Copyright Act (DMCA) notice-and-takedown process. In Australia and other countries, platform infringement forms and legal remedies may be different. We use the rules of the relevant service and jurisdiction.
7. Information in a US DMCA Copyright Notice
Where a US DMCA notice is appropriate, a notice to the service provider’s designated agent generally needs the following information:
• A physical or electronic signature of the copyright owner or authorised representative.
• Identification of the protected work claimed to be infringed.
• Identification and location of the allegedly infringing material sufficient for the service to find it.
• Sufficient contact information for the person making the claim.
• A statement of good-faith belief that the use is not authorised by the owner, an agent or the law.
• An accurate statement, under penalty of perjury, of authority to act on behalf of the owner of the relevant exclusive right.
Notices are sent through the relevant platform’s prescribed process or designated agent, not merely by publishing this policy on our website. We assess applicable exceptions and permissions before submitting a claim. Knowingly false material statements can create legal liability.
8. Counter-Notices and Disputes
The host or platform administering a US DMCA process receives and assesses counter-notices under its legal obligations. We do not have a unilateral legal power to reject a valid counter-notice simply by stating so in a site policy.
If a counter-notice is forwarded to us, we may review it, communicate with the provider or obtain advice on legal proceedings within any applicable statutory timeframe. Disputes may concern authorship, fair use, licence, identification or other rights. We will avoid making unsupported infringement accusations.
9. If You Believe Material on Our Website Infringes Your Rights
Please write to helpingyou@ineedthatdesigns.com with your name and contact details, an identification of the rights you claim, the specific URL or image concerned, an explanation of the concern and any supporting evidence. If you act for someone else, please explain your authority.
We will review good-faith complaints reasonably and may request further detail, investigate licensing, correct attribution, remove material or take other appropriate action. This informal contact route does not replace a legally prescribed notice to an online service provider’s designated agent where one is required.
10. Repeat Misuse and Site Access
Where our website offers customer accounts or submissions, we may restrict access or remove repeatedly unlawful content under applicable law and our Terms of Service. Repeated or serious unauthorised commercial copying from our site may lead to proportionate technical or legal responses.
11. Remedies and International Enforcement
Depending on the facts and the jurisdiction, available steps may include platform reports, a request to cease use, negotiated licensing, injunctions, damages or other remedies provided by law. No remedy or court outcome is guaranteed, and rights outside Australia must be assessed under the relevant country’s laws.
Failing to act on one incident does not necessarily waive our rights in other circumstances. This policy does not create statutory ownership where it would not otherwise exist.
12. Business Continuity and Ownership
Rights may be administered by their lawful owner or an authorised representative. On death or incapacity, ownership or authority is determined by existing legal arrangements, valid wills, powers of attorney and applicable law; this policy is not a will or automatic assignment.
13. Updates and Contact
We may update this policy when legal procedures or our business change. Infringement reports and rights enquiries: helpingyou@ineedthatdesigns.com. Website: www.ineedthatdesigns.com.
